These Terms and Conditions (hereinafter, "Terms") govern the use of the website BERrating.eu (hereinafter, the "Website"). The Website is managed by AstraPharm OU (email: info@BERrating.eu).

Please read these Terms carefully before using the Website. By accessing or using the Website, you agree to be bound by these Terms and the Privacy Policy of BERrating.eu. If you do not agree with these Terms, please do not use the Website.

1. Relationship Between Customer, Company, and Service Providers
1.1. When you place an order on BERrating.eu, AstraPharm OU acts as an intermediary connecting you with an accredited BER Assessor (hereinafter, the "Service Provider"). 1.2. By placing an order, you enter into a contractual agreement with the assigned Service Provider and not with AstraPharm OU. The company does not assume responsibility for any breach of agreement between the customer and the Service Provider.

2. Service Content
2.1. BERrating.eu provides information and facilitates orders for obtaining Building Energy Rating (BER) certificates for various types of properties (apartments, houses, commercial premises, etc.).
2.2. The service may include both free and paid components. The detailed content of the services and their prices are available on the Website.
2.3. AstraPharm OU collaborates with reliable partners but is not responsible for the quality of services provided by third parties.

3. Orders and Payment Terms
3.1. Orders can be placed through the Website by completing the relevant form.
3.2. The company determines pricing based on factors such as property type, size, and location.
3.3. Payments must be made in full at the time of placing the order via available payment methods, including bank transfer and credit card.
3.4. Once the order is confirmed and payment is received, instructions for service delivery will be provided.

4. Right of Withdrawal and Claims
4.1. Customers may withdraw from an order within 7 days if the service has not yet commenced.
4.2. To exercise the right of withdrawal, the customer must submit a digitally signed request to info@BERrating.eu.
4.3. If the requested service has defects, the user has the right to submit a claim within 30 days from receipt of the service.

5. Selection of Service Provider
5.1. When a customer places an order, AstraPharm OU assigns a Service Provider based on factors such as location, availability, and price.
5.2. Customers acknowledge that AstraPharm OU has sole discretion in assigning orders to Service Providers.

6. Disclaimer of Liability
6.1. AstraPharm OU excludes all warranties, conditions, and other terms implied by statute or common law to the fullest extent permitted by law.
6.2. The company is not liable for any loss of profit, loss of goods, loss of data, or loss of goodwill arising out of or in relation to the acts or omissions of the customer or Service Provider.
6.3. AstraPharm OU is not liable for any errors in property certificates resulting from inaccuracies in public registers or third-party sources.
6.4. The company’s total aggregate liability to the customer shall not exceed the cost of the service provided.

7. Indemnification
7.1. The customer agrees to indemnify and hold AstraPharm OU harmless against any claims, losses, damages, liabilities, or expenses arising from any breach of these Terms by the customer.

8. Cancellation Policy
8.1. If a customer cancels an order after confirmation, only a partial refund may be issued, the amount of which is determined by AstraPharm OU.
8.2. If AstraPharm OU cancels an order, the customer will be entitled to a full refund.

9. Customer Obligations
9.1. Customers must ensure an adult is present to grant access to the Service Provider at the agreed appointment time. If access is not granted within 20 minutes, a call-out fee may apply.
9.2. Customers must provide accurate and truthful information when placing an order.
9.3. The customer acknowledges that the timeframe given for service completion is an estimate and not guaranteed.
9.4. Customers must notify the company of any errors in the issued certificate within one month of receiving the service.

10. Prohibited Activities
Customers shall not use the Website for unlawful purposes, including but not limited to: submitting false or misleading information, engaging in fraudulent activity, violating intellectual property rights, circumventing security measures of the Website.

11. Intellectual Property Rights
11.1. The Website, its content, and services remain the property of AstraPharm OU.
11.2. Customers shall not reverse engineer, copy, modify, or distribute any part of the Website without express permission.

12. Termination
12.1. AstraPharm OU may terminate this agreement with immediate effect if a customer engages in misconduct, violates these Terms, or breaches public order regulations.
12.2. Customers may terminate the agreement if AstraPharm OU fails to comply with these Terms.

13. Complaints Procedure
13.1. Complaints should be submitted to info@BERrating.eu.
13.2. AstraPharm OU will acknowledge complaints within 5 working days and aim to resolve them within 4 weeks. If further time is required, customers will be informed accordingly.

14. Modifications and Validity
14.1. AstraPharm OU may update these Terms at any time. Changes take effect upon publication on the Website.
14.2. These Terms are valid as of 22 February 20254 and may be modified at any time without prior notice.
14.3. Users should review the Terms periodically before using the services.
